Code of Practice 9 (COP9) is the name given to an HMRC investigation triggered by suspicions of fraud, and are carried out by the Fraud Investigation Services. Typically, it relates to a perceived shortfall in VAT. This is the most serious type of civil investigation that is undertaken by HMRC and thus the one that provides the greatest levels of worry and anxiety among businesses.

The process of a COP9 investigation entails the investigated party to be offered a Contractual Disclosure Facility (CDF), which is an offer to disclose the tax fraud in question and secure immunity from prosecution. You will be given the option to then either admit to the fraud and accept the CDF offer, or be able to reject the offer. In either situation, you will be faced with the need to be able to provide full details on the suspected fraud, and to seek expert advice at the earliest opportunity.
